Warranty
MK POOLS NEW ZEALAND – SWIMMING POOL WARRANTY
1. Structural Warranty
The swimming pool shell has a lifetime warranty against structural failure due to faulty workmanship or materials, provided that use and maintenance have been carried out in accordance with normal practice and our recommendations.
2. Equipment Warranty
All support equipment — including the pump, filter, lights, and heating — fitted at the time of installation is warranted by the respective manufacturer of that equipment, provided the conditions of those warranties are adhered to.
3. Warranty Exclusions
All warranties shall be invalid if the pool is damaged by:
Earth or ground-fill movement
Acts of God or aggression
Accident, misuse, or intentional, reckless, or negligent acts
To the extent permitted by law, MK Pools New Zealand, its agents, or employees shall not be liable for injury to any person or for any claim of damage, however arising.
4. Normal Wear and Tear
Defects that arise due to normal wear and tear are not covered under warranty.
5. Delivery and Installation Damage
Damage that occurs during the delivery or installation of the product is not covered under this warranty unless the delivery and/or installation is carried out by an authorised agent of MK Pools New Zealand.
6. Warranty Scope
This is the only warranty given by MK Pools New Zealand. All other warranties, conditions, or representations — whether oral, written, express, or implied — are excluded.
7. Notification of Defects
If any defect appears or occurs, the purchaser must inform MK Pools New Zealand or its representative in writing within seven (7) days of the defect being noticed.
The notice must set out the exact nature of the defect and the circumstances in which it was identified.
8. Transfer of Warranty
The Swimming Pool Warranty applies only to the original purchaser and is not transferable to a new owner.
9. Activation of Warranty
This warranty takes effect only once a signed copy of this guarantee has been returned by the purchaser to MK Pools New Zealand or its authorised dealer and signed on behalf of MK Pools New Zealand.
INTERIOR SURFACE WARRANTY
The interior surface of the pool meets the requirements of the Chemical Resistance Test / Cosmetic Layer under Australian Standards AS/NZS 1838:1994 for a period of seven (7) years from the date of installation.
This warranty excludes (but is not limited to) any one or more of the following:
Discolouration, staining, fading, yellowing, or surface degradation caused by incorrect water chemistry, poor water maintenance, or contaminants.
Normal variations that occur over time.
Damage caused by exceeding water temperature parameters (maximum 35 °C, or constant temperatures above 30 °C).
Incorrect application of pool chemicals.
Abrasion or wear due to excessive cleaning or scratches from automatic cleaners.
Pools installed in commercial or rental settings.
Pools or properties not held by the original titleholder, or where the pool has been relocated.
Pool water not maintained in accordance with AS/NZS 3633:1989.
Pools that have been emptied without supervision of the manufacturer.
Performance standards:
Years 1–3: Internal surface complies with AS/NZS 1838:1994 Clause 7.2 (E rating ≤ 4) and Clause 7.3 (F rating ≤ 4).
Years 4–7: Internal surface complies with AS/NZS 1838:1994 Clause 7.2 (E rating ≤ 5) and Clause 7.3 (F rating ≤ 5).
WARRANTY CLAIM PROCEDURE
In the unlikely event that a warranty claim is required, the purchaser must comply with the following process:
Do not attempt to remedy the defect personally or through an unauthorised third party.
Notify both the business from which the pool shell was purchased and MK Pools New Zealand in writing.
Provide the following details:
Date of purchase
Proof of purchase
Date the defect was first noticed
Description and photographs of the defect
Warranty claims must be received by the manufacturer within 30 days of the defect first being noticed.
All information must be legible and complete before the manufacturer will investigate.
CONDITIONS OF CLAIM
Once a claim has been received, the purchaser must provide MK Pools New Zealand, its agents, and employees unrestricted access to the pool shell and surrounds for inspection.
If access is denied or delayed by more than 30 days from the claim date, the warranty claim will not be accepted.
Transport costs for replacement shells are excluded. Loss or damage to property (including grass, paving, landscaping, walls, fencing, walkways, or other improvements and planting) is not covered under this warranty.
MK Pools New Zealand reserves the right to repair or replace the pool shell at its discretion after examination confirms a defect in materials, workmanship, or manufacturing.
Repairs may be carried out in situ and may not cover removal or reinstallation of the shell except where required by law.
This warranty is offered in good faith and is designed to ensure the long-term performance, safety, and quality of your MK Pools New Zealand swimming pool.
